What Maryland Employers Should Know
FAMLI is required: The program applies to Maryland businesses with at least one W-2 employee.
Employers have options: Businesses do not have to automatically participate in Maryland’s state-administered plan and can instead pursue a state-approved private FAMLI insurance plan that provides the required benefits.
Private plans may offer a competitive alternative: Depending on the size and makeup of the company, private coverage may offer competitive pricing along with dedicated resources for claims, administration, compliance, and account questions.
November 15, 2026, is an important deadline: The Declaration of Intent window is now open, and employers that want to pursue a private plan must file with Maryland by November 15 before moving through the private-plan approval process.
